1. Your agreement with us
Please note: You must thoroughly read and agree to these Terms and Conditions before you can use the service(s) and/ or buy products provided by Krsna Diamond Palace. ‘Website’ is identified by as www.krsnadiamondpalace.com. By requesting to access, viewing, using this site OR buying any products/ services from Krsna Diamond Palace (www.krsnadiamondpalace.com), you agree to be bound by these Terms and Conditions. If you do not agree to these terms of service, please refrain from using our Website. By placing an order with Krsna Diamond Palace, you confirm that you are in agreement with and bound by the terms and conditions below.
2. Acceptance of the Terms of Service
Krsna Diamond Palace will carry out work only where an agreement is provided either by email, telephone, mail or fax. Krsna Diamond Palace will carry out work only for clients who are 18 years of age or above. An ‘Order’ deemed to be a written or verbal contract between Krsna Diamond Palace and the client, this includes telephone and email agreements.
3. Changes to the Terms and Conditions
Any required changes to the Terms and Conditions will be incorporated on this page.
4. License
Krsna Diamond Palace will not be liable or become involved in any disputes between the site owner and their clients and cannot be held responsible for any wrong doing on the part of a site owner.
5. Use of the products, services, etc. provided by Krsna Diamond Palace
The products, etc. remain the property of Krsna Diamond Palace until all invoices are paid in full.
6. Your obligations
Whilst every endeavor will be made to ensure that the products purchased from us are free of errors, Krsna Diamond Palace cannot accept responsibility for any losses incurred due to malfunction of the any of the products.
7. Proprietary rights
Any products, material, etc. (unless specifically agreed) written or provided by Krsna Diamond Palace remain the copyright of Krsna Diamond Palace and may only be commercially reproduced or resold with the permission of Krsna Diamond Palace.
8. Charges
Krsna Diamond Palace will not be liable for any costs incurred, compensation or loss of earnings due to the unavailability of any material, etc. provided by its agents.
9. Payment
Once the ordered product has been designed and completed, the final balance of payment is then due in accordance with our payments terms. There are no exceptions to this, i.e. if the Client decides that they no longer want the product(s), as they have commissioned the work and/ or paid a deposit, they are still obliged to pay for the work that has been done. Non-payment will result in legal action being taken, if necessary.
10. Refund policy
Sorry, there is no refund.
11. Exclusion of warranties, limitation of liability and indemnity
Krsna Diamond Palace will not be liable for costs incurred, compensation or loss of earnings due to the failure to meet agreed deadlines.
12. Additional Terms and Conditions
Any additions to the brief will be carried out at the discretion of Krsna Diamond Palace, and where no charge is made by Krsna Diamond Palace for such additions, Krsna Diamond Palace accepts no responsibility to ensure such additions are error-free and reserve the right to charge an according amount for any correction to these or further additions.
13. Your confidential information and your privacy
Whilst ever, and for our clients; this includes telephone AND email and/ or hard copy agreements post telephonic discussion, if any.
15. Miscellaneous
Krsna Diamond Palace will not be responsible for delays or failure due to delivery problems, etc., or any communication or delivery problems associated with the Client’s receipt of the Account Service(s). Krsna Diamond Palace will not be responsible for acts or causes beyond their control, including but not limited to: acts of God, strikes, lockouts, communications line or equipment failures, power failures, earthquakes, or other disasters.
16. Product specific terms
Krsna Diamond Palace cannot take responsibility for any copyright infringements caused by materials submitted by the Client. We reserve the right to refuse any material of a copyrighted nature, unless adequate proof of permission is given to use such material.
